WHISTLEBLOWING
Whistleblowing refers to an act in which an employee or another person connected with an organisation draws attention to possible unlawful or unethical conduct, such as corruption or breaches of legislation. A report (also called a disclosure) may be made either within the organisation or externally, for example to the competent authorities or the media.
JUDr. Robert Hošťálek, attorney, ID No.: 714 63 259, Czech Bar Association reg. No.: 11365, with his registered office at Českomoravská 2408/1a, 190 00 Prague 9 (hereinafter the “Attorney”), is an obliged entity under Act No. 171/2023 Coll., on the whistleblower protection (the “Whistleblower Protection Act”), in conjunction with Act No. 253/2008 Coll., on Certain Measures against the Legalisation of the Proceeds of Crime and Terrorist Financing (the “AML Act”).
The Attorney has established an internal reporting system in accordance with the Whistleblower Protection Act.
In line with that Act, the Attorney accepts and processes reports of suspected unlawful conduct that has occurred or is likely to occur in his practice, submitted by a person who performs or has performed work or other similar activity for him (even indirectly) or has been in contact with him in that context.
The Attorney has excluded from the group of persons entitled to use the internal reporting system those who do not perform work or another similar activity for him within the meaning of Section 2(3)(a), (b), (h) or (i) of the Whistleblower Protection Act, except for persons authorised to make a report under the AML Act.
How to make a report:
You can submit a whistleblowing report in one of the following ways:

The designated person for receiving and reviewing reports and for carrying out other activities under the Whistleblower Protection Act is the Attorney himself.
Reports may be submitted with your name or anonymously. If you provide contact details, we will also inform you about the progress of your report while protecting your identity.
Reports can also be submitted to the Ministry of Justice of the Czech Republic via its reporting system at https://oznamovatel.justice.cz - either by completing the electronic form, by e-mail, or directly to an authorised employee of the ministry. All necessary contacts are listed on that website.
If your report concerns suspected unlawful conduct under the AML Act, you should send it by e-mail to the Financial Analytical Office at reditel@fau.mfcr.cz or to the Czech Bar Association at epodatelna@cak.cz.
What happens after you file a report?
Your report will be acknowledged no later than 7 days after receipt. The designated person will assess its validity and will send you written notice of the outcome within 30 days of receipt. In factually or legally complex cases, this period may be extended by up to 30 days, and this extension may be applied no more than twice. You will be informed in writing of any extension and its reasons before the original deadline expires.
